SwimMatch Service Agreement

This Service Agreement (“Agreement”) is entered into by and between SwimMatch LLC (“Company,” “SwimMatch,” “we,” “our,” or “us”) and the purchasing customer (“Client”).
By purchasing a lesson package, scheduling a session, or participating in any SwimMatch service, the Client agrees to the terms outlined below.
1. Services
SwimMatch is a marketplace platform that connects Clients with independent swim instructors (“Instructors”) who provide private swim lessons.
● Lessons are delivered in a private, 1:1 or small group setting
● Sessions may take place at the Client’s pool or another agreed-upon location
● Lesson durations offered:
- 30 minutes
- 45 minutes
- 60 minutes
● Clients may purchase packages of:
- 6 lessons
- 12 lessons
- 18 lessons
● All lessons within a package must be of the same selected duration
2. Platform Role Disclaimer
SwimMatch operates solely as a technology-based marketplace platform.
SwimMatch does NOT:
- Provide swim instruction directly
- Act as a swim school, lifeguard service, or safety supervisor
- Control or supervise lessons
- Guarantee safety, outcomes, or results
All instruction is performed solely by independent Instructors.
3. Independent Contractor Relationship
All Instructors are independent contractors and are not employees, agents, or representatives of SwimMatch.
SwimMatch does not:
- Train or supervise Instructors
- Control teaching methods or lesson structure
- Evaluate performance in an employment capacity
Instructors are solely responsible for:
- Instruction quality
- Safety decisions
- Conduct during lessons
4. Lesson Packages, Instructor Swapping, & Trial Lesson
● Clients must purchase a lesson package or a trial lesson prior to scheduling sessions
● Full payment is required upfront
Instructor Swapping
If the Client is not satisfied with their instructor, they may choose:
- A different Instructor at no additional cost
Trial Lesson
● A trial lesson may be purchased for $21 on the SwimMatch website.
● Only one trial lesson may be purchased by each client per year.
● Trial lessons are limited to a duration of 30 minutes of instruction and coaching.
● Trial lessons are non-refundable.
5. Payment Terms
● All payments are processed through the SwimMatch website
● Prices are fixed and non-negotiable
● Services will not begin until payment is completed
6. Scheduling, Cancellation & Session Policies
● Clients may schedule sessions based on Instructor availability
● Sessions are flexible and not bound to a fixed schedule
Rescheduling
● Sessions may be rescheduled with adequate notice (recommended: 24 hours)
Late Policy
● If a Client is more than:
- 10 minutes late (30-minute session), or
- 15 minutes late (45-minute session), or
- 20 minutes late (60-minute session)
The session may be forfeited without rescheduling.
No-Shows
● Missed sessions without notice are automatically forfeited
Instructor Cancellations
● If an Instructor cancels, the session will be rescheduled
7. Refund Policy
● Unused sessions may be used within 12 months of purchase.
● Partial refunds may be issued within a Client’s package at the Client’s request, so long as the request is within 12 months of purchase.
8. Instructor Availability & Compatibility
SwimMatch does not guarantee:
- Specific Instructor assignment
- Long-term Instructor continuity
- Immediate availability
Clients may request Instructor changes, subject to availability.
Instructor compatibility is not guaranteed.
9. Client Responsibilities
The Client agrees to:
● Provide a safe and accessible pool or lesson location
● Ensure permission to use the facility
● Provide necessary swim attire and equipment
● Disclose any relevant medical conditions
● Arrive on time and behave respectfully
Failure to comply may result in session forfeiture.
10. Pool & Location Responsibility
The Client is solely responsible for:
● Pool safety and condition
● Water quality and visibility
● Surrounding surfaces and environment
● Compliance with facility rules
SwimMatch does not inspect, manage, or control any pool or facility.
11. Minor Participation
If the participant is a minor:
● The parent or legal guardian must accept this Agreement
● The parent/guardian assumes full responsibility for the minor
● The parent/guardian must supervise as necessary
Swimming carries inherent risks for minors, including drowning.
12. Assumption of Risk
Client acknowledges that swimming and aquatic activities involve inherent risks, including but not limited to:
- Drowning or near-drowning
- Slips and falls
- Water inhalation
- Fatigue or panic
These risks exist regardless of Instructor presence.
Client voluntarily assumes all risks associated with participation.
13. No Guarantee of Safety or Results
SwimMatch does not guarantee:
- Drowning prevention
- Injury prevention
- Instructor performance
- Skill progression or results
Participation is entirely at the Client’s own risk.
14. Release of Liability
To the fullest extent permitted by law, the Client releases SwimMatch, its owners, officers, and affiliates from any and all claims related to:
- Personal injury or death
- Instructor actions or decisions
- Pool or facility conditions
- Participation in lessons
This includes claims arising from negligence to the extent permitted by law.
15. Non-Circumvention
Clients agree not to bypass SwimMatch to work directly with Instructors introduced through the platform.
Violation may result in termination of services and possible legal action.
16. Confidentiality
Client information will be kept confidential and used solely for service delivery.
SwimMatch will not share personal data except as required by law.
17. Termination
● Either party may terminate services at any time
● SwimMatch may terminate services with notice
● No refunds will be issued for unused sessions after the first lesson, except as stated in this Agreement
18. Dispute Resolution
● Parties agree to attempt informal resolution first
● If unresolved, disputes will proceed to mediation and then binding arbitration
All disputes shall take place in Fort Bend County, Texas.
19. Force Majeure
SwimMatch is not liable for delays or cancellations due to events beyond its control, including:
- Weather
- Natural disasters
- Pool closures
- Emergencies
20. Amendments
SwimMatch may update this Agreement at any time.
Updated terms become effective upon posting.
21. Governing Law
This Agreement is governed by the laws of the State of Texas.
22. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements.
23. SMS Communication
